Eden Care Services Home Health Care Agency: Terms and Conditions
Welcome to Eden Care Services. These Terms and Conditions govern your use of our home health aid services. By engaging our services, you agree to these terms. If you do not agree, please do not use our services.
Services Provided
Eden Care Services offers home health aid services, which may include but are not limited to personal care assistance, medication management, health monitoring, and other support as outlined in your care plan. Services are provided based on individual assessments and care plans developed in consultation with you or your authorized representative.
Procedures
An up-to-date information package shall be provided prior to the initiation of services. The information shall be presented in a clear and easily understood manner and include:

  1. List of Services: A list of the home care services that the Direct Care Worker will be providing.

  2. Service Types and Limitations: Types of services offered and their limitations.

  3. Service Plan Development: Process for developing the Service Plan.

  4. Service Agreement Terms: Terms and conditions as set out in the Service Agreement.

  5. Contact Information: Address and contact details for the office.

  6. Hours of Operation: Hours of operation and statutory holidays observed by the Agency.

  7. Licensing and Insurance: Details of license and insurance coverage.

  8. Direct Care Worker Information: The name of the Direct Care Worker(s) who will deliver the services.

  9. Service Schedule: The days and times that services will be delivered.

  10. Fees and Costs: The hourly or weekly fees and total costs for services to be provided.

    • Departmental Representative Contact: The name of a Departmental Representative(s) they can contact for information about:

    • Licensing criteria for home care agencies or registries.

    • The Agency’s responsibilities and adherence to the rules and regulations established for home care agencies.

  11.  Ombudsman Program Contact: The telephone number of the Ombudsman Program located with the local Area Agency on Aging (AAA).

  12. Hiring and Competency Requirements: The hiring and competency requirements for direct care workers to be acceptable for employment or referral by this Agency.

    • Disclosure: A disclosure, prepared in Departmental format, which specifies:

    •  Whether the individuals who provide the services to the client/consumer are Agency employees or are independent/third-party contractors affiliated with the Agency.

    • Which taxes, insurances, and other obligations the Agency and/or clients/consumers are responsible to handle.

  13. Rights & Responsibilities: A copy of the Rights & Responsibilities of Clients & the Agency.

Agency Policies Review: A review of the Agency’s policies on:

  • Confidentiality & Privacy

  • Complaints & Compliments

  • Gifts, Transportation

  • Management of Client’s Money/Property

Scheduling and Cancellations
    •    Scheduling: Appointments and visits will be scheduled according to mutual availability and the care plan established. Changes to the schedule must be communicated with sufficient notice.
    •    Cancellations: You must provide at least [insert number] hours’ notice to cancel or reschedule an appointment. Failure to provide adequate notice may result in a cancellation fee as specified in our fee schedule.
Fees and Payment

  1. Payment Terms: All payments for services rendered by Eden Care Services must be made directly to Eden Care Services. Payments should be made via the methods specified in your service agreement or invoice. 

  2. Authorized Payments: Only payments made to the official bank accounts or payment portals of Eden Care Services are considered valid.Any payments made to unauthorized individuals or accounts will not be recognized by Eden Care Services. Payments are only to be made to the CEO owner and not to any other employees.

  3.  Payment Methods:

    • Credit Cards

    • Checks: Must be mailed to the office location only (210 West Pennsylvania Ave., Suite 100, Towson, MD 21204)

    • Wire Transfers

    • ACH Payments

  4. Receipt of Payment: Clients must ensure that they receive an official receipt from Eden Care Services for all payments made. If you do not receive a receipt, please contact our office immediately.

  5. Unauthorized Transactions: Eden Care Services is not responsible for any payments made to unauthorized individuals or entities. Any such transactions will be considered invalid, and Eden Care Services will not be liable for any losses incurred.

  6. Legal Action: Any attempt to make payments to unauthorized individuals or to use Eden Care Services’ name without permission will result in legal action. This includes but is not limited to, unauthorized cashing of checks or payments made under Eden Care Services’ name.

    •  Security Measures: To protect against unauthorized transactions and potential losses:

    • Always verify the payment details with Eden Care Services before initiating any transaction.

    • Do not share your payment information with unauthorized individuals.

    • Regularly review your payment records and receipts for any discrepancies.

    • Report any suspicious activities or unauthorized transactions to Eden Care Services immediately.

    • Fraud Prevention: Eden Care Services employs robust fraud prevention measures to safeguard your payments. We recommend clients to:

    • Use secure payment methods as specified by Eden Care Services.

    • Keep your banking and payment information confidential.Be cautious of phishing scams or fraudulent communications claiming to be from Eden Care Services.

  8. State Tax and Processing Fee: Payments may be subject to state tax and a 3.5% processing fee.

  9. No Refund Policy: All payments made too Eden Care Services are non-refundable. By making a payment, you acknowledge and agree to this no refund policy.

By engaging with Eden Care Services, you agree to adhere to the above payment terms and conditions. These measures are put in place to ensure the security and integrity of your transactions and to protect against potential losses.
Termination of Services
We may terminate services with 5 days’ notice if:
    •    You fail to comply with the terms of this agreement.
    •    There is a change in your condition that makes it impossible for us to provide care effectively.
    •    We are unable to reach a resolution for issues that significantly impact the quality or safety of care.
You may also terminate services at any time with 5 days’ notice. However, any prepaid fees for services will be non-refundable unless otherwise specified in a written agreement.
Liability
Eden Care Services will not be liable for any indirect, incidental, or consequential damages arising from the use of our services. Our liability is limited to the maximum extent permitted by law.
Dispute Resolution
Any disputes arising from these Terms and Conditions or the services provided will be resolved in accordance with Maryland laws.
Amendments
We may update these Terms and Conditions from time to time. Changes will be effective immediately upon posting. Continued use of our services constitutes acceptance of the updated terms.
Compliance with Maryland Laws
Eden Care Services Home Health Care Agency operates in accordance with Maryland state regulations, including but not limited to:
    •    Certificate of Need (CON): As required by the Maryland Health Care Commission (MHCC), Eden Care Services has obtained a Certificate of Need (CON) to establish and operate as a home health agency.
    •    Licensing Requirements: The agency complies with the licensing requirements set forth in COMAR 10.07.10, ensuring all services are provided by qualified and licensed professionals.
    •    Insurance Coverage: The agency maintains appropriate insurance coverage as mandated by state regulations to protect both clients and employees.
    •    Client Rights and Responsibilities: Clients are provided with a clear statement of their rights and responsibilities, as well as the agency’s responsibilities, in accordance with Maryland law.
    •    Confidentiality and Privacy: The agency adheres to strict confidentiality and privacy policies to protect client information, in compliance with state and federal regulations.
